1. WHAT INFORMATION DO WE COLLECT?

In Short: We do not ask for or collect personal information because we don't ask for any on the website.

We only process personal information that you voluntarily provide to us when you express an interest in obtaining information about us or our products and Services or otherwise when you contact us.

Social Media Login Data. We might have a link to our Facebook page, but will never ask you to register with us using your existing social media account details, like your Facebook, Twitter, or other social media accounts.

In Short: Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This information is primarily needed to maintain the security and operation of our Services and for our internal analytics and reporting purposes.

In Short: Because we do not ask for or collect personal information, we do not communicate with you for security and fraud prevention or basically anything at all.

We do not ask for, collect, or process personal information for any reason, including:

  • We do not facilitate account creation, authentication, or otherwise manage user accounts. There are no user accounts.
  • Apart from providing free audio, we do not deliver or facilitate delivery of other services to the user.
  • We would only process your information to respond to your inquiries and solve any potential issues you might have with the requested service if you contact us by email.
  • We do not send you details about our products and services, changes to our terms and policies, or other similar information, because we do not collect your information.
  • We do not fulfill and manage your orders, payments, returns, and exchanges here (they're not offered). Any purchases are made independently with a third-party website.
  • We do not provide for communication with another user.
  • We do not request feedback and would not contact you about your use of our Services.
  • We do not have marketing purposes and do not have or send marketing emails of any kind.
  • We do not develop or display personalized content and advertising of any kind.
  • We do try to keep our Services safe and secure, including fraud monitoring and prevention, but with no personal information of any kind.
  • We do track non-identifiable information on how you use our Services to better understand how they are being used so we can improve them.
  • We do not provide or leverage targeted marketing and/or user-specific promotional campaigns on this website.
3. WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR INFORMATION?

In Short: We do not ask for or collect personal information. We provide music and streaming services for free without registration or payment and ask nothing from you apart from listening, maybe telling your friends about us, and in general that you continue to be awesome.

If you are located in the EU or UK, this section applies to you.

The General Data Protection Regulation (GDPR) and UK GDPR require us to explain the valid legal bases we rely on in order to process personal information. Since we do not ask for, collect, or process personal information, we have no need for legal bases for processing personal information, because we do not do that.

  • Performance of a Contract. We have no contractual obligations to you, and provide our services for free without personal information from you.
  • Legitimate Interests. We do not ask for or collect personal information, and only occasionally look at non-personal information gathered by those visitor analytics tools.
  • Legal Obligations. We do not ask for or collect personal information because we have no legal obligations. We hope this site remains online after the next global catastrophe but are under no obligation to main this website or Service; we just like doing it.

In legal terms, we are not a “data controller” under European data protection laws of the personal information described in this privacy notice, because we do not ask for or collect personal information.

We do not ask for or collect personal information. It's really that simple. The only way we would know something about your personal information is if you sent us an email and shared what you wanted to share.

We do not ask you to do this. There's no form to fill out. We just have lots of (goofy) music, and you're free to listen (or not) whenever you like.

4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

In Short: We do not need to share any information with third parties in any situation. First of all, we do not have any need to do this. Secondly, we have no personal information to share.

Vendors, Consultants, and Other Third-Party Service Providers.

We will not share your data with third-party vendors, service providers, contractors, or agents (“third parties”) because nobody who performs services for us or on our behalf will ever require access to such information to do that work.

While we do have online hosting and music streaming contracts in place with third parties, they cannot do anything with personal information because we do not have it. As such, nobody will share personal information with any organization.

5. WHAT IS OUR STANCE ON THIRD-PARTY WEBSITES?

In Short: We are not responsible for the safety of any information that you share with third parties that we may link to with our Services.

The Services may link to third-party websites, online services, or mobile applications and/or contain advertisements from third parties that are not affiliated with us and which may link to other websites, services, or applications.

Accordingly, we do not make any guarantee regarding any such third parties, and we will not be liable for any loss or damage caused by the use of such third-party websites, services, or applications.

The inclusion of a link to a third-party website, service, or application does not imply an endorsement by us. We cannot guarantee the safety and privacy of data you provide to any third parties. Any data collected by third parties is not covered by this privacy notice.

We are not responsible for the content or privacy and security practices and policies of any third parties, including other websites, services, or applications that may be linked to or from the Services. You should review the policies of such third parties and contact them directly to respond to your questions.

6. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: We do not use cookies or other tracking technologies to collect and store personal information.

We do not use cookies or similar tracking technologies (like web beacons and pixels) to access or store personal information. As always, you may refuse and/or toss your cookies as you see fit.

7. HOW DO WE HANDLE YOUR SOCIAL LOGINS?

In Short: We do not have any way for you to register or log in to our services using a social media account, so we will not have any access to information about you.

Our Services do not offer you the ability to register and/or log in using your third-party social media account details (like your Facebook or X/Twitter logins). As such, we will not receive any profile information about you from your social media provider.

Besides, we basically think that social media is essentially ruining our society. We only rarely post to FaceBook because some folks still prefer to see updates that way.

8. IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?

In Short: Because we do not ask for or collect personal information, we have no information to transfer, store, or process your information in countries other than your own.

If you are a resident of the European Economic Area (EEA) or the United Kingdom (UK), these countries may not necessarily have data protection laws or other similar laws as comprehensive as those in your country. However, because we do not have personal information, by default we are operating in accordance with this privacy notice and applicable law.

European Commission’s Standard Contractual Clauses:

We have implemented measures to protect personal information, because we do not ask for or collect it in the first place. We have no need for the European Commission’s Standard Contractual Clauses for transfers of personal information between us and our third-party providers because we do not have your information. For your information, these clauses require all recipients to protect personal information that they process originating from the EEA or UK in accordance with European data protection laws and regulations. We have no Data Processing Agreements and thus no Standard Contractual Clauses. We have no need to implement similar appropriate safeguards with our third-party service providers and partners because we do not ask for or collect personal information.

Binding Corporate Rules:

We do not need, nor have, a set of Binding Corporate Rules (“BCRs”) because we do not ask for or collect personal information. Compliance with EEA and UK data protection authorities is not applicable, as we do not ask for or collect personal information.

EU-US and Swiss-US Privacy Shield Framework

A Tribal Smile does not ask for or collect personal information. It is not applicable to comply with the EU-US and Swiss-US Privacy Shield Frameworks as set forth by the US Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union (EU), the UK, and Switzerland to the United States.

Although Privacy Shield is no longer considered a valid transfer mechanism for the purposes of EU and Swiss data protection law, in light of the judgment of the Court of Justice of the European Union in Case C-311/18 and the opinion of the Federal Data Protection and Information Commissioner of Switzerland dated 8 September 2020, A Tribal Smile's compliance with the principles of the EU-US and Swiss-US Privacy Shield Frameworks is not applicable.

A Tribal Smile does not ask for or collect personal information, so adherence and compliance with the Privacy Shield Principles when processing personal information from the EU, UK, or Switzerland is not applicable.

We do not ask for or collect personal information with respect to personal information received or transferred pursuant to the Privacy Shield Frameworks, so conformance with U.S. Federal Trade Commission (“FTC”) stuff is not applicable. Regarding the Privacy Shield Frameworks:

  • WHAT INFORMATION DO WE COLLECT? We do not ask for or collect personal information.
  • HOW DO WE PROCESS YOUR INFORMATION? We do not process personal information because we do not ask for or collect it.
  • WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION? We do not share personal information with anyone, because, if you haven't quite got the gist of things here, we do not ask for or collect personal information.
  • WHAT ARE YOUR PRIVACY RIGHTS? To learn more about the right of individuals to not have their personal data collected, even though we do not do that.
9. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: Because we do not ask for or collect personal information, we do not keep personal information, and much of this privacy policy continues to repeat that same statement. You might be getting tired of reading this, but we're happy to continue saying this stuff for quite a while longer. Read on if you'd like!

We do not have, nor would keep, personal information for the purposes set out in this privacy notice. There is no need for any retention period as required or permitted by law (such as tax, accounting, or other legal requirements). No purpose in this notice will require us to ask for, gather, or keep personal information for any length of time.

We have no ongoing legitimate business need to process personal information, so if you proactively send us an email, we will delete such information, or, if this is not possible (for example, because personal information has been stored an automated email backup archives), then we will securely store personal information and isolate it from any further processing until deletion is possible.

10. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: Because we do not ask for or collect personal information, a system of organizational and technical security measures is not applicable.

We have implemented appropriate and reasonable technical and organizational security measures designed to not ask for or collect personal information. So that's the scoop... we do not ask for or collect personal information, and it's up to you to be careful with your own information -- and please do not share anything with us.

11. DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect data from or market to children under 18 years of age, because, as stated above, we do not ask for or collect personal information.

We do not knowingly solicit data from or market to anyone, including children under 18 years of age. By using the Services, you do not have to be at least 18 and you do not need to either ask for or provide to another your consent to someone else's use of the Services.

12. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: In some regions, such as the European Economic Area (EEA), United Kingdom (UK), and Canada, you have rights that allow you greater access to and control over your personal information. That's awesome, and we do not ask for or collect personal information anyway.

In some regions (like the EEA, UK, and Canada), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; and (iv) if applicable, to data portability. In certain circumstances, you may also have the right to object to the processing of your personal information. The good news is that we do not ask for or collect your personal information, so this is not an issue you need to worry about.

We will consider and act upon any request in accordance with applicable data protection laws, especially since we do not ask for or collect personal information.

Opting out of marketing and promotional communications: Good news! We do not contribute to your email clutter with any spam, marketing, or promotional communications at any time. There is nothing for you to stop or unsubscribe because we do not send anything out, except for groovy music sent over the interwebs for your enjoyment.

Account Information:

Because we do not ask for or collect personal information, and you do not have an account with us, you will not need to:

  • Log in to your account settings and update your user account (we do not have accounts and there are no settings)
  • Contact us using the contact information provided (because we do not ask for or collect your contact information)

There is no account so you have no need to request to terminate an account, and we cannot deactivate or delete your account and information from our active databases because we do not have accounts or databases. All this stuff is hand-coded HTML with a few scripts to play the music and stuff like that.

Cookies and similar technologies: Most Web browsers are set to accept cookies by default, and that's for you to decide. We do not issue or track cookies. There's nothing to remove or reject, at least from our stuff. Feel free to toss your cookies whenever you'd like, as it won't affect your ability to enjoy music from A Tribal Smile.

13. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected.

That's awesome. As you've probably surmised by now, we do not ask for or collect personal information. Feel free to activate all the DNT you'd like.

14. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: Yes, if you are a resident of California, you are granted specific rights regarding access to your personal information. Please note that we do not ask for or collect personal information.

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year.

If you are a California resident and would like to make such a request, please submit your request to us via email at privacy@tribalsmile.com. Knowing that we do not ask for or collect personal information, please do not be surprised that we reply saying that we have none because we do not have any.

If you are under 18 years of age and reside in California, there's no need to worry -- you cannot register an account with the Services, nor do you have the ability to publicly post information on the Services. Feel free to email us if you would like, but again, we will not have any way to help you because we do not ask for or collect personal information.

CCPA Privacy Notice

The California Code of Regulations defines a “resident” as:

(1) every individual who is in the State of California for other than a temporary or transitory purpose and
(2) every individual who is domiciled in the State of California who is outside the State of California for a temporary or transitory purpose

All other individuals are defined as “non-residents.”

  • Beacons/Pixels/Tags (nope, none of that stuff)
  • Click redirects (none, sorry we're being repetitive)
  • Social media plugins (guess what? None at all)

Because we do not ask for or collect personal information, there's no need to worry about us selling or sharing personal information.

Given we do not ask for or collect personal information, if you are using an authorized agent to exercise your right to opt-out, we may deny a request if the authorized agent does not submit proof that they have been validly authorized to act on your behalf.

They'd be disappointed, anyway, because we do not ask for or collect personal information.

Will your information be shared with anyone else?

Because we do not ask for or collect personal information, there's nothing for us to disclose with our service providers under a written contract between us and each service provider.

By the way, each service provider is a for-profit entity that provides cool services for us without needing any of your personal information; yet in general, they follow the same strict privacy protection obligations mandated by the CCPA.

We have not, or ever, disclosed personal information or categories of personal information to third parties for a business or commercial purpose in the preceding twelve (12) months because we do not ask for or collect personal information.

Your rights with respect to your personal data

Right to request deletion of the data — Request to delete

We do not ask for or collect personal information. You can ask for the deletion of your personal information if you'd like, and because we do not ask for or collect personal information, it will be a quick request (there's nothing for us to delete).

If you ask us to delete your personal information, we will respect your request and reply with a friendly hello, because we have no personal information to delete.

Depending on the circumstances, you have a right to know:

Financial Incentives

“Financial incentive” means a program, benefit, or other offering, including payments to consumers as compensation, for the disclosure, deletion, sharing, or sale of personal information.

Because we do not ask for or collect personal information, there is nothing for us to gain financially or otherwise. We don't make any money here, because nobody seems to buy our albums or merch. Not even the baby onesie or the playing cards.

But making money isn't our objective (although it'd be cool if somebody purchased an album someday). So do not worry -- we have no personal information to sell, trade, barter, offer, or bet on horse races.

Metrics

Our metrics for all CCPA requests received for the previous calendar year are available upon request at privacy@tribalsmile.com. As you might expect, we anticipate few, if any, CCPA requests because we do not ask for or collect personal information.

15. DO VIRGINIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: Yes, if you are a resident of Virginia, you may be granted specific rights regarding access to and use of your personal information. And the even better news is, we do not ask for or collect personal information.

Virginia CDPA Privacy Notice

Under the Virginia Consumer Data Protection Act (CDPA):

Verification process

We may request that you provide additional information reasonably necessary to verify you and your consumer’s request. If you submit the request through an authorized agent, we may need to collect additional information to verify your identity before processing your request.

Upon receiving your request, we will respond without undue delay, but in all cases, within forty-five (45) days of receipt. The response period may be extended once by forty-five (45) additional days when reasonably necessary. We will inform you of any such extension within the initial 45-day response period, together with the reason for the extension.

Again, none of the above really applies at all because we do not ask for or collect personal information. Just thought you might like to know.

Right to appeal

If we decline to take action regarding your request, we will inform you of our decision and reasoning behind it (we won't need to, because we do not ask for or collect personal information). If you wish to appeal our decision, please email us at privacy@tribalsmile.com. Within sixty (60) days of receipt of an appeal, we will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If your appeal is denied, which it will not be because we do not ask for or collect personal information, you may contact the Attorney General to submit a complaint.
